This article deals with the issue of the choice of law ruling the economic relationship between foreign married partners who are resident in Italy. The Italian law 218 of the 1995 reforming the international private law determines the field of application of the Italian jurisdiction and the criteria to individuate the applicable law.
Concerning the economic relationship between married couples, if they have the same nationality, the common national law of the two partners will be enforced. In case the two partners have two different citizenships, it will be enforced the law of the state where the marriage predominantly takes place.
The Italian law offers a further opportunity: The two partners may agree in a written form that their economic affairs will be regulated by the law of the state of which at least one of them is citizen. Such a choice has to occur not only in written form but also at the presence of an Italian notary public. In case the choice will fall on the Italian law it’s important to explain the way the Italian law regulates economic relationships in reference with the purchase of real estate properties. The economy of UK will keep dipping in and out of growth this year. According to Sir Mervyn King, the chief of Bank of England the UK economy will “zigzag” this year. With so many filings and such a complex tax code, most huge corporations are undoubtedly making errors when complying with the tax regulations. In some cases, it may be intention. In most case, however, it is probably a situation of human error and simply be overwhelmed with the sheer volume of work that has to be done.
So, does the IRS audit large corporations as aggressively as it does you and me? It is hard to say. What is clear is the agency is doing less audits than in past years and is spending less time on them. A recent study by the Transaction Records Access Clearinghouse at Syracuse University found the IRS audit rate of large corporations dropped nearly 10 percent this year and the time spent on the audit also dropped.
Does this mean the IRS is giving the big boys a free ride or at least less bumpy one? Not really. The IRS still audited 35.5 percent of all businesses with over $250 million in assets. Think about that for a second. The big boys stand a 1 in 3 chance of being audited. In comparison, individual taxpayers stand a 2 in 100 chance. Given these ratios, it is fairly difficult to argue big business is getting a break.
